The Indiana family of an unarmed, mentally ill Ohio man who died after police tortured him seven times with a Taser stun gun has settled its wrongful-death lawsuit in the case. The city of Mason, Ohio and two police officers settled lawsuit for $375,000.
39-year-old Doug Boucher died in December 2009 after a confrontation with two officers outside a Mason convenience store. Mason police said at the time that Boucher had died after being tortured by taser gun.
No wonder.
Boucher had been stunned seven times, and he was immobile and face-down on the ground for five of them.
I don't track taser deaths as much as I once did ... but, this killing happened in my hometown. I'm very sorry for the loss experienced by the Boucher family.

Taser Lawsuit: Douglas Boucher vs. City of Mason (Ohio)
Mason (OH) police officers Daniel Fry and Sean McCormick are being sued by the family of the 39-year old man they killed in December 2009. The family's lawsuit claims the officers tased their son, Douglas Boucher a total of six times in less than a minute and hit him and kicked him after he was down. Boucher was in a gas station market acting like a jerk with the female cashier. Being a jerk isn't usually punishable by death.
The City of Mason disagrees. They filed a motion to have the family's lawsuit ... currently scheduled for February 19, 2013 ... dismissed.
This blog is more than a little interested in this particular lawsuit and taser-related killing ... the gas station where it all took place is less than a mile from my local public library!

Taser Lawsuit: Douglas Boucher (Mason, OH)
Mason police officers tased 39-year old Douglas Boucher in December 2009. He died. The police didn't see anything wrong with it. No charges were filed against the two officers. The family of the dead man see it differently. Boucher's family filed a federal lawsuit. [SOURCE]
The autopsy didn't indicate that the taser was the cause of death. The lawsuit claims that the two police officers used excessive force on a mentally ill person. The family seeks compensatory and punitive damages from the city of Mason and officers Daniel Fry and Sean McCormick.
The two police officers were not called onto the scene. They just stopped by the same Speedway gas station where a female clerk was serving Mr. Boucher. When the police arrived, the clerk alleged that Boucher was harassing her. The two officers asked Boucher to go outside. The officers were attempting to handcuff Boucher when he wrestled away and hit Fry in the head with his one handcuffed hand, according to the police. When he tried to go after the clerk again - she had come outside - McCormick attempted to use a Taser on him. The first shot failed, but the second electrocution with the 50,000 volts from the taser gun knocked Boucher to the ground. He hit his head on the concrete and died.

The lawsuit claims that "Mason police officers arrested him, tased him in the chest and in the back and then, while he was on the ground, struck him with a police baton, kicked him and tased him five more times."The report issued by the Ohio powers-that-be did note that the police officers failed to 'spark test' their taser guns ... to the device may have given off more that the 50,000 volts of electricity specified by the manufacturer.

Taser Cops Daniel Fry and Sean McCormick Back at Work After Killing Douglas Boucher
I see that Officers Daniel Fry and Sean McCormick, the two Mason police officers who killed a man with their taser last month are back on the job. [SOURCE]Mason Police Chief Mike Kelly says he reinstated the officers because he's convinced they did nothing wrong.
A coroner's report shows 39-year old Douglas Boucher died from a skull fracture when his head hit the ground after officers used a taser on him on December 13. The officers attempted to revive Bo
ucher, but he was pronounced dead at the West Chester Medical Center. It amazes me how basic cause-and-effect logic doesn't embarrass the Powers-That-Be when they try to cover up for the police in these taser-related killings. For example, the coroner says that Mr. Boucher dies from a skull fracture when he hit his head on the ground.
Of course, he never falls to the ground if the police don't overreact by using their taser in the first place. When you have 50,000 volts of electricity pumped through your body ... it is hard to maintain your balance.
Oops.
He fell and smashed his skull. Powers-That-Be tell us that this death was the fault of the victim ... had nothing to do with the taser blast ... and we believe them?
Powers-That-Be don't even try to use commonsense in these taser-related killings. Mr. Boucher flirts with a gas station attendant ... and a few minutes later he is tasered ... then he is dead. And the Powers-That-Be put the taser-killing cops back on the job as if nothing happened?
What is wrong with this picture?

Taser Autopsy: Douglas Boucher (Mason OH)

Douglas Boucher, 39, died earlier this month after being approached by two Mason police officers (Daniel Fry and Sean McCormick) about his efforts to flirt with female clerk at local gas station. Boucher flirted ... clerk complained to local cops ... local cops tased Boucher ... Boucher died. Boucher was a loving father, son and musician. He had a full life ahead of him. He was not a substantial threat to the two police officers. Now he is dead. [SOURCE]
Butler County coroner said an autopsy revealed the cause of Boucher’s death was a skull fracture, which he received when he fell face forward after Officer McCormick pumped his body with 50,000 volts of electricity.

No drugs or alcohol were found in Boucher's body.
I'm curious to see what, if any, action will be taken to discipline the two police officers? They are both on paid administrative leave, pending an investigation of the incident.

Taser Death: Douglas Boucher (Mason OH)
Douglas Boucher, 39, was killed by tasers in suburban Cincinnati after a struggle that occurred less than a mile from his home. Mason police officers Daniel Fry and Sean McCormick jolted 50,000 volts of electricity from their taser guns into Boucher after he was involved in a crash at a local gas station.
The man died just minutes later. [SOURCE]
Mason officers Fry and McCormick, who stopped at the station for drinks just after 11 p.m., say Boucher started harassing the store clerk. She asked officers for help after he allegedly made several profane sexual requests. She told officers Boucher made the same advances Saturday night.
The patrol officers, Daniel Fry and Sean McCormick, ordered Boucher outside.
Once outside, police said, he became combative. When they tried to handcuff Boucher, officers said he wrestled away, hitting Fry over the head with his cuffed hand and chasing after the station attendant. Fry was treated and released for his injury.
After one unsuccessful try, McCormick stunned Boucher with his gun. He hit the pavement "hard" and stopped breathing.
Officers performed CPR before a Mason EMS squad rushed him to West Chester Medical Center. Emergency crews were unable to revive him.
Butler County Coroner Richard Burkhardt said the autopsy has not been completed. He did not issue a preliminary cause of death.
Both Fry and McCormick have been placed on paid administrative leave. They’ve been with the department three years.
The department has no plans to change its Taser policy, and the Mason police chief says that it does not appear McCormick violated department rules. Mason officers, who all have carried X26 Tasers since Spring 2007, have never had any problems or deaths after using the devices, officials said.
Boucher was a musician who played bass for a couple of local bands includ
ing Hellcat Alley. Reached at their home in Marion, Ind., Boucher’s parents declined comment, saying they were still trying to learn all the details.
Villagers, this time is different. Mr. Boucher was not a criminal. He was not on drugs. He was not in an excited state of delirium. He was just a bloke who made an inappropriate pass at the wrong time and in the wrong place. The penalty for inappropriate sexual comments (WORDS) should never be death.
Something is horribly wrong with the way that tasers are being used around the nation. Too many people are dying.

"I know what they say, but I don’t know what happened."Douglas Boucher has an 8-year-old daughter, Kathryn, who lives in Mason with his former wife and her husband. The couple gently broke the news of her father’s death to the girl on Monday morning.
"Our daughter was his light and inspiration and they enjoyed their visits tremendously. Today is a sad day for her," said Sheryl Olszewski, Boucher’s former wife. He was a very passionate person – passionate about his daughter, his music and living life fully," she said.Boucher’s ex-wife did not address the incident at the gas station but did add: "I know of no drug abuse."
